20th May 2024: An word from Gareth Overton
I'm vice-chair of Friends of Western Harbour Ponds, the formal organisation that was created so we can take action and be consulted as a body.
Summary of current status:
The would-be buyers of the wetland and woodland plots were due to hold two "PAN" consultations (Proposal of Application Notice). In other words, they were consulting with the community about the Planning Permission they would seek if they went ahead and bought the plots, from the current owner (which is a company based in the British Virgin Islands).
The first meeting took place in February 2024 but the second, due to take place on 2 May2024, was cancelled or postponed, and we've not heard why or whether it is being rescheduled. So we don't know the current thinking of the would-be buyers. Because the prospective buyer is already dealing with the current owner, we are too late to invoke community buyout rights, under which you get preferential treatment.
Anyway, aside from the above, people have been building relationships with stakeholders (e.g. the local community council, local school, local politicians), meeting with bodies that might be able to help us (e.g. advisers on community buyout options), recording the wildlife, raising funds for possible actions that might cost money, gathering signatures to our petition and much more.

Eric MacLennan secured a Tree Preservation Order (TPO) for the trees at the site, which was made permanent in December in quite a dramatic victory.
A Tree Preservation Order in Scotland is a legal tool used by local authorities to protect specific trees, groups of trees, or woodlands that offer significant public amenity or ecological value.
